Terms of Service

These Terms of Service ("Terms") govern your access to and use of CircuitForge (the "Service"), operated from the Philippines and available at circuitforgeph.com. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
CircuitForge is an IoT management platform that lets registered users flash firmware onto supported ESP32-based devices and monitor those devices through a web dashboard. Access to flashing is governed by a credit system, described below.
2. Accounts
- You must provide accurate information when registering and keep your credentials secure.
- You are responsible for all activity that occurs under your account.
- You must be legally capable of entering into these Terms in your jurisdiction.
- We may suspend or terminate accounts that violate these Terms.
3. Flash Credits
- Flashing a new device consumes one (1) flash credit. Re-flashing a device already registered to your account does not consume a credit.
- Credits are granted by CircuitForge, typically following a purchase, and are tied to your account.
- Credits have no cash value, are non-transferable except as expressly permitted by us, and are generally non-refundable except where required by law.
- You may not attempt to obtain credits or flash devices by circumventing the credit system.
4. Acceptable Use
You agree not to:
- reverse engineer, decompile, extract, redistribute, or resell the firmware, keys, or the Service except as permitted by us in writing;
- access accounts, devices, or data that are not yours;
- interfere with, overload, or disrupt the Service or its infrastructure;
- use the Service for any unlawful purpose or in violation of any applicable law or regulation.
5. Intellectual Property
The Service, including its firmware, software, branding, and content, is owned by CircuitForge and its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service and to run the firmware on devices you have flashed under a valid credit. No other rights are granted.
6. Devices and Hardware
You are responsible for the hardware you connect to and flash. Flashing firmware can erase existing data and settings on a device. You accept the risks associated with flashing and operating your own hardware.
7. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
8. Limitation of Liability
To the maximum extent permitted by law, CircuitForge will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or hardware, arising from your use of the Service. Our total liability for any claim will not exceed the amount you paid us for credits in the twelve (12) months before the claim.
9. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or if we discontinue the Service. Provisions that by their nature should survive termination will survive.
10. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
11. Governing Law
These Terms are governed by the laws of the Republic of the Philippines, without regard to conflict-of-law principles. Disputes will be subject to the exclusive jurisdiction of the competent courts of the Philippines.
